Oakville Tree Removal: What to Know First
📋 The Town of Oakville Private Tree Protection By-law
The Town of Oakville's Private Tree Protection By-law (By-law 2017-038) controls tree removal on private property. According to the Town, a permit is required to remove a tree with a trunk diameter of 15 cm or more measured at breast height, which the Town defines as 137 cm above the ground. A trunk circumference of about 47 cm or less means the tree is under that size. A permit is also required for trees that must be retained or planted as a condition of an approved site plan. Smaller trees do not need a permit under the by-law.
The Town says the owner, or someone applying on the owner's behalf with a signed letter of authorization, can apply online. For a tree on a shared property line, the Town asks for a signed letter of consent from the neighbouring owner. After you apply, a tree inspector from the Town's Forestry Section contacts you to arrange an on-site consultation, and an approved permit is posted where it is visible from the road before removal. The Town also says healthy trees removed above the 15 cm size must be replaced with new trees. Fees, security deposits and processing times are set by the Town and can change, so we do not quote them here; confirm them with the Town of Oakville.
🚨 Dead, Hazardous and Emergency Trees
The Town of Oakville states that dead and high-risk trees, ash trees and buckthorn still require a permit, although the permit fee is waived. It also states that you do not need a permit for an emergency tree removal, but you must notify the Town as soon as possible. If a tree is blocking a driveway after a storm or leaning toward the house, make the area safe and call us on 647-558-1366. We target a 2-hour response window across the GTA, 24/7 including weekends and statutory holidays. Our hazardous tree removal service includes a written risk report.
🌆 Town Trees and Boulevards
Not every tree in front of an Oakville home belongs to the homeowner. The Town explains that tree ownership is determined by location, and trees on a municipal right of way are the Town's. The Town prunes and removes its own trees, and an owner who wants a contractor to do approved work on a Town tree must first submit the Town's contractor agreement form and receive approval. Report a Town tree with a problem to ServiceOakville at 905-845-6601. Ask us during the estimate if you are unsure which side of the line a tree sits on.
🌲 Woodlands, Ravines and Halton Region
The Town's private tree by-law does not apply to woodlands or greenlands that are governed by the Halton Region Tree By-law 121-05. Properties near ravines or natural areas can fall under that regional by-law instead, so check with the Town of Oakville or Halton Region if your lot includes a wooded area. We also serve neighbouring Burlington and the rest of Halton Region.
🐛 Ash Trees and Tree Health
Emerald ash borer is an invasive insect that has killed ash trees across southern Ontario, and the Town of Oakville lists ash trees as fee-exempt (permit still required) in its permit process. If an ash tree is thinning, shedding bark or dropping branches, have it assessed early; we can tell you whether it needs to come down.
